05

Our Lawful Bases for Processing

UK data protection law requires us to have a lawful basis for processing personal information. The basis we rely upon depends on why we are using the information.

Contract
Where processing is necessary to take steps at your request before entering into a contract or to perform a contract with you.
Legitimate interests
Where processing is reasonably necessary for our legitimate business interests or those of another organisation, provided those interests are not overridden by your rights and interests. This may include responding to business enquiries, administering customer relationships, improving our services, maintaining security and pursuing appropriate B2B business development.
Legal obligation
Where we need to process information to comply with a legal or regulatory obligation, including applicable tax, accounting and legal requirements.
Consent
Where we ask for and you provide valid consent for a particular purpose, such as certain marketing activities or non-essential website technologies. Where processing relies on consent, you can withdraw that consent.
06

Marketing Communications

We may use business contact information to communicate with customers and prospective customers about EasyRack products, services, guides and relevant business developments where permitted by applicable law.

Where consent is required for a particular form of electronic marketing, we will seek that consent before sending the relevant communication.

You can ask us to stop sending marketing communications at any time by using the unsubscribe option provided in the communication, where available, or by contacting us.

Opting out of marketing does not prevent us from sending service messages relating to an enquiry, quotation, order, account or existing business relationship where those communications are necessary.

07

Who We May Share Information With

We do not sell personal information.

We may share relevant information with organisations that help us operate EasyRack or fulfil a customer project. Depending on the circumstances, these may include:

  • racking manufacturers and suppliers;
  • installation partners and contractors;
  • transport and logistics providers;
  • website, hosting and IT service providers;
  • CRM, email and business software providers;
  • payment and finance service providers;
  • accountants, insurers, legal advisers and other professional advisers;
  • regulators, law enforcement agencies, courts or public authorities where required; and
  • prospective purchasers, investors or advisers in connection with a genuine corporate transaction where appropriate safeguards are used.

We only disclose information that is reasonably necessary for the relevant purpose.

08

International Data Transfers

Some of the technology providers, suppliers or other organisations we use may process information outside the United Kingdom.

Where personal information is transferred internationally, we will take appropriate steps required by applicable data protection law to protect the information. Depending on the destination and circumstances, this may include relying on recognised adequacy arrangements or appropriate contractual safeguards.

You can contact us if you would like further information about safeguards relevant to your personal information.

09

How Long We Keep Information

We keep personal information only for as long as reasonably necessary for the purpose for which it was collected and to meet applicable legal, accounting, tax, contractual and operational requirements.

The appropriate retention period depends on the nature of the information and our relationship with you.

For example, project, quotation and customer records may need to be retained after a project has finished so that we can maintain an appropriate record of the products supplied, specifications, correspondence and contractual relationship.

Enquiries that do not result in an order may be retained for an appropriate period where there is a legitimate business reason to do so.

When information is no longer required, we will delete, anonymise or securely dispose of it as appropriate.

10

How We Protect Your Information

We take reasonable technical and organisational measures designed to protect personal information against unauthorised access, loss, misuse, alteration or disclosure.

Access to personal information is restricted to people and service providers who reasonably need access for the relevant business purpose.

No internet or electronic storage system can be guaranteed to be completely secure. We therefore continually consider appropriate security measures in light of the nature of the information we process and the systems we use.

11

Cookies & Similar Technologies

Our website may use cookies and similar technologies to provide website functionality, maintain security, remember preferences and, where enabled, understand how visitors use our website.

Essential cookies

Some cookies or similar technologies may be necessary for the website or a service requested by the user to function correctly. These may be used without asking for consent where permitted by law.

Optional cookies

Where our website uses non-essential cookies or similar technologies that require consent, we will ask for your choice before using them.

You can use the cookie controls made available on the website to manage applicable preferences.

These rights do not apply in exactly the same way in every situation, and there may be circumstances where the law permits or requires us to retain or continue processing information.

13

Questions & Complaints

If you have a question or concern about how EasyRack uses your personal information, please contact us first so that we can investigate and respond.
